The plaintiff instituted a delictual claim against the Minister of Police based on the alleged negligent handling of a criminal investigation in which he was the complainant. He alleged that the investigating officer misrepresented that there was no documentary evidence, which led the Deputy Director of Public Prosecutions to provisionally decline to prosecute on 28 May 2014. As a result of the alleged mismanagement, the suspect was released and later left the country, causing the plaintiff financial loss. The plaintiff issued summons on 4 May 2017. The defendant raised a special plea of prescription, contending that the debt arose in 2012 when the negligent conduct occurred. The parties agreed to argue the prescription plea by way of a stated case under Uniform Rule 33(1). However, the stated case failed to clearly set out the critical dates and facts relevant to when prescription began to run. The plaintiff had earlier obtained unopposed condonation for non-compliance with the Institution of Legal Proceedings against Certain Organs of State Act 40 of 2002.
