Wolfkop and Others v Minister of Police

The plaintiffs arose from the fatal shooting of Caroline Arends by her ex-husband, Gert Arends, a serving SAPS member, on the night of 30 September to 1 October 2013. Gert used a SAPS service firearm despite having been declared unfit to possess a firearm and thereafter committed suicide. The second plaintiff was held hostage during the incident. The first and second plaintiffs were married at the time but later divorced, allegedly due to the trauma. The third to fifth plaintiffs are the children of Caroline and Gert. The Minister of Police conceded liability on the merits for the unlawful shooting and hostage-taking, and the proceedings concerned quantum only.

The first plaintiff’s claim was dismissed with no costs order. The second plaintiff was awarded R220,000 as per the defendant’s tender. The third plaintiff was awarded R332,470; the fourth plaintiff R424,956; and the fifth plaintiff R578,248, inclusive of loss of support, general damages, and future medical expenses. Interest was awarded from date of judgment. The defendant was ordered to pay the costs of the second to fifth plaintiffs, including expert costs and the costs of two counsel.

The judgment reinforces South African evidentiary principles that expert opinion must rest on proven facts and cannot substitute for primary testimony, even where merits are conceded. It clarifies the limits of psychological expert evidence in delictual quantum disputes and affirms the approach to assessing loss of support and psychiatric damages for dependent children following unlawful police conduct.
