The Directorate of Special Operations (DSO), known as the Scorpions, was established under the National Prosecuting Authority Act 32 of 1998 as a specialised investigative and prosecutorial unit within the National Prosecuting Authority (NPA). Following internal political debates and resolutions adopted by the governing African National Congress, Cabinet decided in April 2008 to initiate legislation to disestablish the DSO and relocate its functions to the South African Police Service (SAPS). Draft legislation (the NPA Amendment Bill and the SAPS Amendment Bill) was approved by Cabinet and introduced into Parliament. Hugh Glenister, a businessman acting in his own interest, in the public interest, and on behalf of others, sought urgent judicial intervention to interdict the executive from initiating and persisting with the passage of legislation dissolving the DSO, arguing that the decision was unconstitutional and that irreversible harm would occur before the legislative process concluded.
