The Welverdiend Community lodged a claim under the Restitution of Land Rights Act 22 of 1994 for land from which it had been dispossessed under racially discriminatory laws and practices in KwaZulu-Natal. The community was forcibly removed from its homes, threatened with imprisonment, and had livestock and farming equipment impounded. Initially the community sought restoration of the land, opposed by the then landowners. After hearings and inspections in loco, the community abandoned restoration and elected to pursue monetary compensation only. The State accepted liability for compensation under its Financial Compensation Policy. The remaining dispute concerned whether, in addition to policy-based financial compensation, the community was entitled to solatium (recompense for trauma, humiliation and suffering), which the community quantified at R5 million per household.
