Following the Acting National Director of Public Prosecutions’ (ANDPP) 2009 decision to discontinue the prosecution of Mr Jacob Zuma, the Democratic Alliance (DA) sought to review that decision. In earlier litigation, the Supreme Court of Appeal (SCA) ordered the NDPP to produce the record of the decision under Uniform Rule 53, excluding Zuma’s confidential representations. The NDPP failed to comply fully, withholding audio recordings (the so‑called ‘spy tapes’), transcripts, and internal memoranda allegedly on grounds of confidentiality. The DA approached the North Gauteng High Court to compel compliance. The High Court ordered production of the recordings, transcripts, and internal documents subject to safeguards for confidentiality. Mr Zuma appealed that order to the SCA.
