The applicants, children of the late Mzimasi Richmond Madubela, disputed the respondents’ claim that they were also biological children of the deceased. The respondents had lodged claims against the deceased estate, alleging a right to inherit. While both parties agreed that DNA testing was necessary to resolve the paternity dispute, they disagreed on the method: the respondents insisted that the deceased’s remains be exhumed for DNA testing, whereas the applicants sought an order compelling the respondents to undergo DNA testing using the applicants’ DNA and, if necessary, that of the deceased’s siblings. The respondents raised points in limine regarding non-joinder of their mother and the Master of the High Court, and the late filing of the applicants’ replying affidavit.
