Nieuco Properties 1005 (Pty) Ltd owned the farm Glengarry in Mpumalanga, where it and a co-appellant farmed macadamia nuts. The neighbouring farm, Hanging Stone, was owned by the Minister of Rural Development and Land Reform but had been leased to a third party. On 7 June 2012 a veldfire spread from Hanging Stone onto Glengarry, causing extensive damage to the appellants’ macadamia orchards. The appellants sued the Minister in delict, relying on alleged non-compliance with duties imposed on landowners by the National Veld and Forest Fire Act 101 of 1998. The Minister contended that because the land was leased at the time, he was not an ‘owner’ as defined in the Act and therefore bore no liability. This legal question was separated and decided in the Minister’s favour by the Gauteng Division of the High Court, Pretoria, leading to an appeal to the Supreme Court of Appeal.
