The accused, Sisonke Gwavu, was convicted on 21 January 2025 of raping his nine-year-old niece on more than one occasion, involving both anal and vaginal penetration, without her consent. The first incident occurred when the accused was 17 years old and the second after he had turned 18. The accused was responsible for caring for his bedridden mother and the complainant at the time. The State invoked section 51(1) of the Criminal Law Amendment Act 105 of 1997 due to the complainant’s age and the fact that the rape occurred on multiple occasions. The accused was a first offender and had been in custody for approximately one year awaiting sentence. Psychological and pre-sentence reports were submitted detailing the complainant’s trauma and the accused’s personal circumstances.
