The appellant and a co-accused were tried in the Regional Court, Gqeberha, on a charge of rape arising from events on 12 February 2020 near St George’s Park, Gqeberha. The complainant testified that the appellant, whom she recognised from the taxi rank, offered her a lift in a minibus, threatened her with an object, and raped her in the vehicle. A second man, who had been in the back seat, also raped her. She later reported the matter, identified the co-accused at the taxi rank, and identified the appellant via a Facebook image and subsequently at a car wash. Both accused were convicted and sentenced to life imprisonment. The appellant raised an alibi, supported by his wife, claiming he was at his fiancée’s home and a party on the night in question. He appealed against both conviction and sentence, but abandoned the appeal against sentence.
