The first applicant, Gcinilizwe Londile, was recognised in 2008 as the Senior Traditional Leader (Senior Chief) of the Amatolandile Traditional Council, Tsolo. The first respondent, Pollen Sibongiseni Bikwe, later claimed entitlement to that position on the basis of customary lineage. A Provincial Committee on Traditional Leadership Disputes and Claims investigated the claim and recommended that the first respondent be recognised as Senior Chief. The Premier of the Eastern Cape accepted this recommendation, and the MEC for Local Government and Traditional Affairs advised the first applicant to vacate office. The applicants challenged these decisions by way of a Rule 53 review, contending that the Commission and Committee lacked jurisdiction, that no valid claim had been lodged, that statutory dispute-resolution procedures under the Traditional Leadership and Governance Framework Act were not followed, and that the process was procedurally unfair.
