The accused, Hlumelo Yali, was convicted of raping a seven-year-old girl during October 2022. The complainant had gone to the house where the accused was staying to play with a friend. The accused lured her into his room with the offer of chips, undressed her, and sexually penetrated her both anally and vaginally with his penis. He continued despite her pleas to stop, causing her pain and distress. Medical evidence confirmed a broken hymen and anal trauma. The complainant suffered significant psychological harm, including post-traumatic stress symptoms. The accused was a first offender, approximately 21–22 years old at the time, unemployed, poorly educated, and had been in custody for over two years prior to sentencing due largely to psychiatric observation.
