The appellant was convicted in the Mthatha Regional Court on one count of rape of his biological daughter, who was about 14 years old at the time of the alleged incident. The complainant testified as a single witness that the appellant touched her breasts, assaulted her, and inserted his penis into her vagina while they were living together. She first reported the incident to a family friend, Pamela, asking about reporting sexual assault, and later laid a charge of rape. Medical evidence (J88) recorded a whitish discharge but DNA analysis detected no semen, and the doctor concluded only that sexual assault probably occurred. Despite these evidential difficulties, the trial court convicted the appellant of rape but deviated from the prescribed life sentence and imposed 15 years’ imprisonment.
