The trustees of the Hugo Louw Trust owned agricultural land (the farm Lange Kloof) within the jurisdiction of the Swartland Municipality. Elsana Quarry (Pty) Ltd, with the trust’s consent, obtained a mining right under s 23 of the Minerals and Petroleum Resources Development Act 28 of 2002 (MPRDA) to mine granite on the land. The land was zoned ‘Agricultural I’ under the Land Use Planning Ordinance 15 of 1985 (LUPO), which did not permit mining. Although a rezoning application to ‘Industrial III’ (which would allow mining) was initially lodged, it was withdrawn after advice from the Department of Mineral Resources that national government had exclusive competence over mining. When mining preparations commenced, the municipality objected and sought an interdict to stop mining until rezoning was obtained. The High Court granted the interdict, holding that LUPO still applied despite the grant of a mining right. The Minister of Mineral Resources persisted with an appeal to the Supreme Court of Appeal.
