The Land and Agricultural Development Bank of South Africa (Land Bank) advanced four loans to a farmer, Mr Thorold Doubell, under the Land Bank Act 13 of 1944—two secured and two unsecured. Doubell was finally sequestrated in August 2000. After the sale of all estate assets, a free residue remained for concurrent creditors. The Land Bank, still owed more than R2 million, sought in 2004 to invoke sections 33 and 34 of the Land and Agricultural Development Bank Act 15 of 2002 to attach the free residue and claim preference. The advances, however, had been made under the repealed 1944 Act, not under the 2002 Act. The Master did not confirm the liquidation and distribution account pending resolution of the Bank’s objection.
