Thina Dukada v Minister of Police

The plaintiff sued the Minister of Police for damages arising from an alleged unlawful arrest and detention on a charge of rape. The plaintiff, a teacher, was arrested without a warrant in June 2022 following a rape complaint laid by the victim’s mother. The victim identified the plaintiff as the perpetrator, pointed him out to the police, and stated that he was her teacher. The arresting officer relied on the victim’s statement, her friend’s statement, and a J88 medical report. There were discrepancies between the J88, which recorded the perpetrator as unknown, and the witness statements, as well as differences between the victim’s and her friend’s versions. The plaintiff was detained overnight and released the following day when he appeared in court, with a note indicating no prospects of a successful prosecution.

The plaintiff’s claim for unlawful arrest and detention was dismissed. No order as to costs was made.

The case reaffirms the objective test for reasonable suspicion under section 40(1)(b) of the Criminal Procedure Act and illustrates how courts assess discrepancies in evidence at the stage of arrest. It confirms that positive identification by a complainant in a serious Schedule 1 offence such as rape can constitute sufficient grounds for a lawful warrantless arrest, even where inconsistencies exist in medical or witness reports.
