The appellant, Queen Sibongile Winnifred Zulu, was married to the late King Goodwill Zwelithini kaBhekuzulu Zulu in 1969 by a civil marriage in community of property and profit and loss under the Marriage Act 25 of 1961. During the subsistence of that marriage, the late King entered into several customary marriages with other women, who are the first to fifth respondents. After the King’s death, disputes arose within the Zulu Royal Family. The appellant sought declaratory relief in the KwaZulu-Natal High Court declaring her civil marriage and that, by virtue of it, the late King was legally precluded from concluding any further marriages, whether civil or customary. The High Court dismissed the application, finding that the civil marriage and its consequences were common cause and that no practical effect would flow from a declaratory order. The appellant appealed to the Supreme Court of Appeal.
