The appellant, Compensation Solutions (Pty) Ltd (CompSol), administered and purchased medical aid claims from medical practitioners who treated employees injured at work under the Compensation for Occupational Injuries and Diseases Act 130 of 1993 (COIDA). Due to persistent delays and failures by the Compensation Commissioner to process and pay medical accounts, CompSol instituted litigation. In July 2009 the parties concluded a settlement agreement, signed personally by the Commissioner and made an order of court, obliging the Commissioner to process, validate and pay medical accounts within defined time periods and to cooperate operationally with CompSol. Despite repeated undertakings, further court orders, and prior contempt proceedings, the Commissioner consistently failed to comply. By July 2013 unpaid validated claims exceeding R93 million remained outstanding for longer than the 75-day period prescribed by the court order. CompSol launched further contempt proceedings seeking a declaration of contempt and committal. The High Court held that the Commissioner was not in contempt, prompting this appeal to the Supreme Court of Appeal.
