The President of South Africa invoked section 8(a) of the Judges’ Remuneration and Conditions of Employment Act 47 of 2001 to extend the term of office of Chief Justice Sandile Ngcobo by five years beyond the expiry of his 12-year non-renewable constitutional term. This was the first use of section 8(a). Several civil society organisations and associations brought urgent applications for direct access to the Constitutional Court, challenging the constitutionality of section 8(a) and, if valid, the President’s conduct in extending the Chief Justice’s term. The Chief Justice abided the Court’s decision, while the President and Minister opposed the applications.
