The appellants, Mr Mahlangu and Mr Mtsweni (later represented by his estate), were arrested without a warrant on four counts of murder in May 2005. Mr Mahlangu was assaulted by police and, as a result, made a confession implicating himself and Mr Mtsweni. This confession was later found to have been obtained unlawfully through torture and without proper warning of rights. The appellants were brought before a magistrate two days after their arrest and were repeatedly remanded in custody on the basis of court orders, remaining detained until February 2006 when the Director of Public Prosecutions withdrew all charges. The trial court held the arrests and police detention unlawful and awarded limited damages, but refused to hold the Minister of Police liable for the period of detention following the first court appearance. The full court upheld that refusal, leading to the appeal before the Supreme Court of Appeal.
