The applicant and first respondent are the biological parents of the deceased, Siyamthemba Mbalane, who died intestate on 24 December 2024. The deceased was buried on 2 January 2025 at his maternal home, being the first respondent’s residence. The applicant sought urgent relief to exhume the deceased’s body and rebury him at the applicant’s home, alleging that the parties were married under customary law and that, according to custom and the deceased’s wishes (inferred from rituals such as ukwaluka performed at the paternal home), burial should have taken place at the paternal home. The first respondent denied the existence of a customary marriage, contending that she raised the children alone, that no lobola was paid, and that the burial at her home was proper. Evidence from a family elder and a tribal authority supported her version. The dispute centred on burial rights, customary law, and whether exhumation was justified.
