Default judgment for R260 000 was granted against the Minister of Police in the Regional Court, Idutywa. Warrants of execution were issued on 4 March 2025. The sheriff attached and inventorised the applicant’s movable property on 11 April 2025, and removed the goods, including two motor vehicles, on 10 June 2025. The applicant launched an urgent application in the High Court seeking to stay the warrant of execution and to have the attached goods returned, alleging urgency on the basis that the police docket relevant to the defence had gone missing and was only found on 20 May 2025. The respondents opposed the application, contending that the urgency was self-created due to the applicant’s delay.
