The plaintiff, Standard Bank of South Africa Limited, advanced a home loan of R785 000 to Olympia Development CC in August 2005 for property development. As security, a mortgage bond was registered over immovable property and the members of the close corporation, including the third defendant, executed unlimited deeds of suretyship binding themselves as co‑principal debtors. The close corporation defaulted on the loan, leaving an outstanding balance of R717 201.93. The plaintiff applied for summary judgment against the third defendant based on the suretyship, and for default judgment against the remaining defendants who failed to defend. The third defendant admitted signing the suretyship but alleged that he was married in community of property at the time and that his spouse had not consented in writing, rendering the suretyship unenforceable. He further alleged that the suretyship document was altered after signature to reflect him as unmarried.
