The appellant was convicted in the Regional Court, Soweto, of kidnapping and rape under section 3 of the Criminal Law (Sexual Offences and Related Matters) Amendment Act 32 of 2007, arising from events on 30 August 2004. The complainant testified that the appellant forcibly entered her home armed with a knife, abducted her against her will, and raped her multiple times at his residence. Medical evidence corroborated recent sexual intercourse. The appellant denied the allegations, claiming the sexual encounter was consensual and occurred at his home after the complainant voluntarily visited him. Following conviction, the matter was referred to the High Court for sentencing in terms of section 52 of the Criminal Law Amendment Act 105 of 1997, and the appellant was sentenced to life imprisonment for rape and eight years’ imprisonment for kidnapping, to run concurrently.
