The parties are spouses involved in acrimonious divorce proceedings initially instituted in the Western Cape Division. While the divorce was pending there, the respondent wife launched an urgent Uniform Rule 43 application in the Eastern Cape Division seeking increased maintenance. Nobatana AJ granted an order on 23 July 2024 increasing maintenance from R26 000 to R55 000 per month and granting ancillary relief. The husband, resident and domiciled in Dubai at the time, failed to comply. The wife then instituted contempt proceedings. In response, the husband applied for rescission/variation of the July 2024 order under Rule 42, the common law, and s 8 of the Divorce Act, contending that the Eastern Cape court lacked jurisdiction to grant a Rule 43 order when the divorce was pending in another division. Separately, the wife sought an urgent variation of a February 2025 agreed order regulating responsibility for private school fees, alleging changed circumstances and non‑cooperation by the husband.
