The Makhuva-Mathebula Community lodged a land restitution claim in December 1997 under the Restitution of Land Rights Act 22 of 1994. In the prescribed claim form, the community identified specific properties as claimed land, including Letaba Rest Camp, Lulekani, Zebra, Genoeg, Pompey and Quagga. Maps were attached to the claim form, but the written description in the form listed only those properties. The Regional Land Claims Commissioner (RLCC) published the claim in the Government Gazette in stages between 2007 and 2015 as investigations progressed. The community contended that the initial 2007 publication was incomplete and that the RLCC failed to consider the maps attached to the claim form, which allegedly depicted a far larger area of land. The community sought judicial review of the RLCC’s decision to publish the claim as described in the claim form. The Land Claims Court dismissed the review application, and the community appealed to the Supreme Court of Appeal.
