The State v Rashid Sebastian Bouwer

The accused, Rashid Sebastian Bouwer, was 17 years old at the time of the offences. In the early hours of 15 October 2023, after consuming alcohol with friends in the northern suburbs of Gqeberha, he was handed a firearm by a friend. Believing it to be a toy but foreseeing the possibility that it might be real, and after encouragement from his peers including the deceased, he pulled the trigger. The firearm was loaded and the shot fatally wounded the deceased. Shocked, the accused fled home and asked his family to take him to the police, where he was arrested. He was convicted of murder and unlawful possession of a firearm and ammunition. The magistrate sentenced him to effective direct imprisonment despite a probation officer’s recommendation that he was a suitable candidate for correctional supervision.

The convictions were confirmed. The sentences of direct imprisonment were set aside and replaced with a sentence of 10 years’ imprisonment wholly suspended for five years on condition that the accused is not convicted of a violent offence during the period of suspension, together with three years’ correctional supervision subject to strict conditions, including house detention, community service, employment obligations, rehabilitation programmes, and monitoring. The declaration that the accused is unfit to possess a firearm was confirmed.

The case reaffirms the constitutional and statutory principle that imprisonment of child offenders must be a measure of last resort. It underscores that sentencing courts must go beyond the traditional Zinn triad and meaningfully apply the child-centred framework of the Child Justice Act. The judgment strengthens the jurisprudence emphasising rehabilitation and reintegration over retribution and deterrence in child sentencing, even in cases involving serious offences such as murder.
