Siyanda Hololo v Minister of Police and Another

The plaintiff instituted an action for damages against the Minister of Police and the National Director of Public Prosecutions, claiming R3 million for alleged unlawful arrest and detention. He was arrested by SAPS on 9 October 2015 on a charge of murder arising from an incident at Zonwabele Tavern on 26 September 2015, where the deceased was assaulted and later died. An eyewitness, Ms Ntozini, identified the plaintiff as one of the assailants. The plaintiff was detained until his first court appearance on 12 October 2015, after which he remained in custody until he was released on bail on 12 November 2015 due to postponements for bail profiling. The murder charge was ultimately withdrawn on 30 March 2016 after a post-mortem report indicated that the deceased died from injuries sustained in a motor vehicle accident. The plaintiff alleged that his arrest and continued detention were unlawful and malicious, and that the police and prosecutors acted without reasonable grounds and with improper motive.

The plaintiff’s claims for unlawful arrest and detention were dismissed with costs on Scale A.

The case reaffirms the application of section 40(1)(b) of the Criminal Procedure Act and the objective test for reasonable suspicion in unlawful arrest claims. It underscores that later developments, such as the withdrawal of charges, do not retrospectively render an arrest unlawful. The judgment also clarifies the high threshold for establishing malicious deprivation of liberty and the limited liability of police and prosecutors for post-court detention ordered under the statutory bail framework for Schedule 5 offences.
