The plaintiff instituted an action for damages against the Minister of Police and the National Director of Public Prosecutions, claiming R3 million for alleged unlawful arrest and detention. He was arrested by SAPS on 9 October 2015 on a charge of murder arising from an incident at Zonwabele Tavern on 26 September 2015, where the deceased was assaulted and later died. An eyewitness, Ms Ntozini, identified the plaintiff as one of the assailants. The plaintiff was detained until his first court appearance on 12 October 2015, after which he remained in custody until he was released on bail on 12 November 2015 due to postponements for bail profiling. The murder charge was ultimately withdrawn on 30 March 2016 after a post-mortem report indicated that the deceased died from injuries sustained in a motor vehicle accident. The plaintiff alleged that his arrest and continued detention were unlawful and malicious, and that the police and prosecutors acted without reasonable grounds and with improper motive.
