The parties were married in community of property on 26 July 1999 and had two children, both of whom are now majors. The marriage broke down irretrievably, and although both parties sought a divorce, they disputed the cause of the breakdown and the patrimonial consequences. The plaintiff sought a division of the joint estate including 50% of the defendant’s pension interest in the Government Employees Pension Fund. The defendant resisted this and counterclaimed for forfeiture, alleging that throughout the marriage she was the sole financial supporter of the household and children, that the plaintiff failed to contribute despite having income, and that he was physically, verbally, and emotionally abusive, including incidents involving a firearm. Evidence from the defendant and the parties’ daughter supported these allegations. The plaintiff denied misconduct and claimed he made some financial contributions, but his evidence was found to be vague and unconvincing.
