The iSimangaliso Wetland Park Authority is the statutory management authority of the iSimangaliso Wetland Park, a UNESCO World Heritage Site that includes the St Lucia Estuary. The estuary historically functioned as a single system influenced by river inflows, including the Umfolozi River, and periodic natural breaching of the estuarine mouth. In 2005, heavy rainfall caused the Umfolozi River to flood, resulting in back flooding onto sugar farms owned by shareholders of Umfolozi Sugar Planters Limited. The appellants approached the KwaZulu-Natal High Court seeking an order compelling iSimangaliso to breach the estuary mouth to prevent flooding. An initial urgent application was settled by consent. Thereafter, the appellants brought further urgent and contempt applications alleging non-compliance by iSimangaliso. By the time the matter was argued, the appellants no longer pursued the original relief but contended that iSimangaliso acted arbitrarily and unlawfully. The High Court dismissed the applications, finding iSimangaliso’s conduct lawful and authorised under the World Heritage Convention Act. On appeal to the Supreme Court of Appeal, the appellants abandoned the urgent and contempt relief and sought amended relief, including enforcement of a timetable for an estuarine management plan and a declaratory order.
