The plaintiff, a 19-year-old male, was arrested without a warrant on 7 February 2021 by members of the SAPS at his home in Stutterheim on allegations of raping a nine-year-old minor on two occasions. The arrest followed statements obtained from the complainant (the child’s mother), the child victim, a supporting J88 medico-legal report indicating sexual penetration, and further corroborative information. The plaintiff was detained overnight in police cells, appeared in the Zwelitsha Magistrates’ Court on 8 February 2021, and was remanded in custody after bail was initially opposed. He remained detained until 24 February 2021, when he was released on bail. The criminal matter was later struck from the roll and ultimately withdrawn. The plaintiff instituted a civil action claiming damages for unlawful arrest and detention; a claim for malicious prosecution was abandoned at trial.
