Merile v Minister of Police and Another

The plaintiff, a 19-year-old male, was arrested without a warrant on 7 February 2021 by members of the SAPS at his home in Stutterheim on allegations of raping a nine-year-old minor on two occasions. The arrest followed statements obtained from the complainant (the child’s mother), the child victim, a supporting J88 medico-legal report indicating sexual penetration, and further corroborative information. The plaintiff was detained overnight in police cells, appeared in the Zwelitsha Magistrates’ Court on 8 February 2021, and was remanded in custody after bail was initially opposed. He remained detained until 24 February 2021, when he was released on bail. The criminal matter was later struck from the roll and ultimately withdrawn. The plaintiff instituted a civil action claiming damages for unlawful arrest and detention; a claim for malicious prosecution was abandoned at trial.

The plaintiff’s claims for unlawful arrest and detention were dismissed. The plaintiff was ordered to pay the defendant’s costs.

The judgment reaffirms established principles governing arrest without a warrant under section 40(1)(b) of the CPA, particularly the low threshold for reasonable suspicion and the objective test applied by courts. It underscores the discretion afforded to police officers in serious offences involving minors and threats to victims, and clarifies that subsequent detention pursuant to court orders will not ordinarily render the police liable absent proof of unlawful or negligent conduct.
