The accused, Mbulelo Shumi, was convicted of rape in contravention of section 3 of the Criminal Law (Sexual Offences and Related Matters) Amendment Act 32 of 2007. The complainant was an 11-year-old girl, born on 14 June 2013, who was repeatedly subjected to anal sexual intercourse by the accused, her paternal uncle. The accused occupied a position of trust and authority within the family, often caring for the complainant and her siblings due to the physical disability of the complainant’s mother. The abuse caused severe psychological trauma to the child, including behavioural changes, emotional distress, trust issues, anxiety, and risks of long-term mental health consequences, as confirmed by a clinical psychologist’s report. The accused was a first offender, unemployed, 37 years old, and had spent approximately four to five months in custody awaiting trial.
