The parties entered into four interrelated agreements for scaffolding services and equipment hire at the Medupi and Kusile power stations, comprising separate services and hire agreements for each site. Electro-Heat Energy (Pty) Ltd instituted two separate actions against Wetback Contracts (Pty) Ltd under different case numbers for payment of outstanding invoices arising from these agreements. A central dispute in both actions concerned the allocation of payments made by the respondent from a single bank account across the four agreements. Wetback Contracts opposed the applicant’s application to consolidate the two actions under Rule 11 of the Uniform Rules of Court, alleging potential prejudice due to disputes relating to payment allocation and the involvement of different sites. The respondent had also filed identical counterclaims in both actions, alleging overpayment and seeking repayment based on the same contractual interpretation issues.
