The applicant, Bekentla Zwelitsha, has been employed by the King Sabata Dalindyebo Local Municipality since 2005. In June 2006 he was appointed on a temporary acting basis as Acting Assistant Security Manager, with an agreement that he would receive an acting allowance until he was relieved of the acting appointment, the situation was reviewed, or the post was filled. He alleges that although he continued performing the acting duties for many years and the post was never filled nor reviewed, the municipality stopped paying his acting allowance from October 2018 (with intermittent payment in 2019) without notice or explanation. The municipality contended that the acting allowance was erroneously paid because the relevant post ceased to exist following the abolition of the 2004 staff establishment and its replacement with a 2010 staff establishment. It further relied on a letter dated 27 June 2012, signed by the applicant, placing him permanently in a different post, which it argued constituted a review of his position and employment conditions.
