The plaintiff, Giza Technologies (Pty) Ltd, entered into an oral agreement with the defendant, Albert de Buys, during November/December 2015 for the purchase of a group of pure bred Damara Springbuck, including a breeding ram, ewes and lambs, for R174 420 (VAT inclusive), payable in two instalments. Only part of the animals were delivered in June 2016 to the plaintiff’s farm near Somerset East. Several animals died shortly after delivery, the breeding ram was never delivered, and expert evidence later established that the animals delivered were not Damara Springbuck but of a different ecotype with significantly lower value. The plaintiff cancelled the contract and claimed damages for short delivery, diminished value, and loss of future lambs. A second claim concerned a separate agreement for a King Springbuck ewe, but delivery never physically occurred. The defendant did not attend trial.
