Aphelele Mpiyonke v Minister of Police

The plaintiff was arrested without a warrant by members of the South African Police Service on 12 November 2021 at Mount Ayliff following allegations by a truck driver that he felt unsafe and suspected a possible hijacking. The plaintiff and his two friends were handcuffed, not informed of the reasons for arrest, and their constitutional rights were not explained. They were detained in poor and dehumanising conditions until 15 November 2021. Although taken to court, the plaintiff never appeared before a magistrate and was released without being prosecuted. The defendant’s defence was struck out for failure to comply with discovery, and the matter proceeded as an unopposed application for default judgment.

The defendant was held liable for the unlawful arrest and detention of the plaintiff from 12 to 15 November 2021 and ordered to pay damages of R125,000, interest at the prescribed legal rate from date of judgment to final payment, and the plaintiff’s costs of suit on Scale A in terms of Uniform Rule 67A.

The case reinforces established South African jurisprudence that arrests and detentions are prima facie unlawful and underscores the strict duty on police to justify warrantless arrests. It highlights constitutional protections of liberty and dignity, particularly in default judgment proceedings where the state fails to present evidence, and provides guidance on the assessment of damages for unlawful arrest and detention.
