The plaintiff was arrested without a warrant by members of the South African Police Service on 12 November 2021 at Mount Ayliff following allegations by a truck driver that he felt unsafe and suspected a possible hijacking. The plaintiff and his two friends were handcuffed, not informed of the reasons for arrest, and their constitutional rights were not explained. They were detained in poor and dehumanising conditions until 15 November 2021. Although taken to court, the plaintiff never appeared before a magistrate and was released without being prosecuted. The defendant’s defence was struck out for failure to comply with discovery, and the matter proceeded as an unopposed application for default judgment.
