The applicants, Willem Jacobus Albertus Oosthuizen and Theo Martins Jackson, were convicted in the Gauteng Division of the High Court (sitting as the Mpumalanga Division, Middelburg) on multiple serious offences, including assault with intent to do grievous bodily harm, kidnapping, attempted murder, and intimidation. Jackson was additionally convicted of defeating or obstructing the course of justice. They received effective sentences of 11 years’ and 14 years’ imprisonment respectively. After conviction, they applied for bail pending an application for leave to appeal on the merits. The High Court refused bail, finding that any sentence imposed on appeal would likely remain custodial.
