The South African Navy, as part of the South African National Defence Force, implemented the Military Skills Development System (MSDS) to recruit and train young persons for military service. The MSDS imposed age requirements: combat recruits had to be between 18 and 22 years old, and graduate recruits between 18 and 26 years old. The Tebeila Institute of Leadership, Education, Governance and Training, acting in the interests of affected individuals and the public, challenged these age requirements. Tebeila alleged that the upper age limits unfairly excluded persons over 26 from applying, constituted unfair discrimination on the ground of age under section 9 of the Constitution, infringed the right to further education under section 29(1)(b), and breached the State’s obligations under section 7(2). The High Court upheld the challenge and declared the policy invalid. The Navy and the Minister of Defence appealed to the Supreme Court of Appeal.
