The South African Riding for the Disabled Association (the Association) occupied Erf 142 Constantia, Cape Town, for 34 years under a lawful lease from the State and allegedly made improvements valued at R7.5 million. The Land Claims Court initially awarded different land to the Sadien family as restitution for apartheid-era dispossession, but later varied its order to substitute Erf 142 Constantia without notifying the Association or determining compensation. Section 35(9) of the Restitution of Land Rights Act entitles lawful occupiers of state land to just and equitable compensation if such land is restored to claimants. The Association sought to intervene and to rescind the varied order, but the Land Claims Court dismissed the intervention application, holding that the Association lacked a direct and substantial interest.
