The applicant leased business premises from the respondent in terms of a written lease agreement concluded on 1 April 2020, which was to endure until 31 March 2025. Due to the applicant’s failure to pay rentals in accordance with the lease, the applicant cancelled the lease on 28 September 2022, which cancellation was accepted by the respondent. Upon vacating the premises, the applicant left movable property and equipment inside the leased premises. The respondent refused to release these movable items, asserting a tacit hypothec to secure payment of outstanding rental arrears.
